Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Pinpoint Club Information System (the “Service”), operated by Pinpoint (“Pinpoint,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a club or organization, you represent that you are authorized to accept these Terms on its behalf.

The Service

Pinpoint is a club information system for archery programs, including USA Archery JOAD and Adult Archery Program clubs, that helps clubs manage people, sessions and classes, attendance, scores, pins, credentials, documents, and communications. We may add, change, or remove features over time.

Eligibility and accounts

• Accounts are intended for adult coaches, administrators, and volunteers, and for parents or guardians who are granted access to their own archer’s information through the family portal. You must be at least 18 years old to create an account.
• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
• Notify us promptly if you believe your account has been accessed without your authorization.

Your data and responsibilities

The information you and your club enter into the Service (“Club Data”) remains yours. You grant us a limited license to host, process, and display Club Data solely to provide the Service to you. You are responsible for:

• The accuracy of Club Data and your authority to provide it, including obtaining any consent required from members, parents, or guardians, especially for information about children.
• Limiting the information you collect to what your program genuinely needs, and granting access within your club only to those who should have it.
• Complying with all laws that apply to your collection and use of Club Data, and with USA Archery’s policies where applicable.

Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Access data you are not authorized to access, or attempt to defeat the Service’s security or tenant isolation.
• Interfere with or disrupt the Service, or place an unreasonable load on our infrastructure.
• Reverse engineer, copy, or resell the Service except as permitted by law.
• Upload malicious code or content that infringes the rights of others.

Fees

Some features of the Service may be offered for a fee. Where fees apply, the applicable pricing and payment terms will be presented to you before you incur a charge. Unless stated otherwise, fees are non-refundable except as required by law.

Intellectual property

The Service, including its software, design, and the Pinpoint name and logo, is owned by Pinpoint and protected by intellectual-property laws. These Terms do not grant you any rights in the Service except the limited right to use it as described here. Club Data is excluded from this section and remains yours.

Service availability

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may perform maintenance, suspend, or discontinue parts of the Service, and we will make reasonable efforts to give notice of significant changes. Pre-release or non-production environments may be unstable and are provided for evaluation only.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. You are responsible for maintaining your own records and backups of information that is important to you.

Limitation of liability

To the fullest extent permitted by law, Pinpoint will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the claim, or one hundred US dollars.

Indemnification

You agree to indemnify and hold harmless Pinpoint from any claims, damages, and expenses arising out of Club Data you provide, your use of the Service, or your violation of these Terms or of any law or third-party right.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. On termination, your right to use the Service ends. Provisions that by their nature should survive, such as the data, intellectual property, disclaimer, liability, and indemnification sections, will survive.

Governing law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Minnesota for any dispute that is not subject to other agreement.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after a change takes effect means you accept the updated Terms.
